Andhra Pradesh government has sought central guidelines on operationalisation of section 8 of Andhra Pradesh Reorganization Act of 2014. Section 8 of Andhra Pradesh Reorganization Act, 2014 deals with Responsibility of Governor to protect residents of common capital of Hyderabad.
The Andhra Pradesh chief secretary claimed that the centre is considering issuing guidelines to this effect. If the act is amended, rules can be framed on the powers of governor. But, as the law is not amended, guidelines have to be issued to operationalise section 8, he claimed.
But, the Telangana state chief secretary said that no such move is on the anvil. The Telangana government has once again differed on the move of the Andhra Pradesh government. The Telangana chief secretary said that there is no need for any guidelines on the implementation of section 8 as the said section in the act is self explanatory.
The plea of Andhra Pradesh Government to empower the Governor with a set of guidelines regarding his powers over the present joint capital of the two States - Hyderabad - was turned down by the Union Home Ministry here on Saturday, revealed sources.
At a meeting of the Chief Secretaries of the two States Union Home Secretary L C Goyal is said to have given a patient hearing to the arguments of the two CSs in this regard and advised them against such guidelines without any provocation as it would lead to a new controversy.
The Home Secretary said to have remarked that the Centre would look into the necessity when a grave situation arose and till then the present law would prevail. It may be recalled that both the governments have earlier sharply differed on the question of Governor’s powers on Hyderabad. Both the state governments have given different interpretations on this section of the act.
The Telangana government has all along been opposing any wider interpretation of the section and has been asserting that the Telangana state government has full powers on Hyderabad. Andhra Pradesh government has a contrary view on the subject as the city remains the common capital.
