The two-judge PIL Bench of the High Court at Hyderabad comprising of acting Chief Justice Dilip B. Bhosale and Justice S V Bhatt on Monday while reserving orders proposed to continue the ongoing process of conducting written examination and interview process of the successful candidates appearing for subordinate judicial officer examination.

However, the Hon'ble Court said that the appointment will not be done until further orders. The counsel for the petitioners and the Advocate General for the State of Telangana opposed the said option proposed by the Hon'ble Court. They pointed out that the Rules with regard to these examinations are framed by the State Government and since the ongoing examinations were contrary to the said rules it could be given judicial acceptance.


The PIL Bench was dealing with three writ petition filed challenging the action the authorities in not bifurcating the subordinate judicial officers and judicial employees of the erstwhile state of Andhra Pradesh and not distributing subordinate Judicial Officers and other employees to the State of Telangana and to the State of Andhra Pradesh.


The petitioners questioned the notifications issued in February 2014 and 2015 as null and void, arbitrary, illegal and violative of Articles 233 and 234 of Constitution of India .
