Hyderabad: The Telangana High Court on Thursday disposed of two writ appeals filed by Sushee Infra and Mining Pvt Ltd. The company had challenged a single judge order directing it to implead the successful bidder in its petitions against the tender for Radial Road-2 (RR-2). The division bench directed the company to go back to the single judge for further hearing. The division bench of Acting Chief Justice Puthichira Sam Koshy and Justice Suddala Chalapathi Rao heard the appeals, arising from the tender for constructing RR-2 over 81.15 km, from the Outer Ring Road at Kothwalguda (Budvel) to NH-167N near Nacharam. The appeals concerned package 1, covering Budvel to Shabad. The company was not successful in the tender process.

The company had filed two writs on October 12 challenging the rejection of its bid. It said it had quoted a lower price than the successful bidder. It sought a direction that the tender not be finalised. The single judge had directed it to implead the successful bidder, observing that no orders could be passed without hearing that bidder. The petitions were posted to October 29 for further hearing.

The company then filed two writ appeals, 1152 and 1153 of 2026, against the single judge direction. The division bench asked why the company had not impleaded the successful bidder as directed.

Senior counsel Desai Prakash Reddy, appearing for the company, argued that its technical bids were rejected despite its lower price. He said the L-1 bidder's price for the three projects was about Rs 600 crore higher than the company's quoted price. This, he contended, had been ignored and would place an additional burden on the State exchequer.

The bench disposed of the appeals and directed the company to approach the single judge for further hearing.
