The Delhi High Court will hear a habeas corpus petition on Monday in relation to a right wing blogger Swatantra Bhardwaj who was arrested after allegedly assaulting the father of a student activist while he was out at Jantar Mantar during a protest.

Bhardwaj's lawyer had requested an urgent hearing and the matter was brought up before a bench of Chief Justice DK Upadhyaya and Justice Tejas Karia. The counsel has told the court that Bhardwaj had spent the past three days in custody.

Bhardwaj was arrested after being detained in Bulandshahr, Uttar Pradesh on Friday. He was then produced in front of a court in Delhi and booked in one day police custody on Saturday.

The arrest came in the wake of criticism leveled by the actor on a video podcast regarding his right to make racist and sexist comments. The arrest came after the actor faced criticism for allegedly making racist and sexist comments in a video podcast. He allegedly “cracked the skull” of the father of a minor protester, the “Father of the Nation” during the protest, in the video.

Later Bhardwaj said he had done so in self-defence. In response, Delhi Police claimed that the injuries sustained by the student's father were “simple.”

A court in Delhi on Sunday put Bhardwaj under one-day judicial custody after the scheduled castes and scheduled tribes (Prevention of Atrocities) Act was invoked in the case.

The Delhi Police produced Bhardwaj before the video conferencing Duty Magistrate Anjali Singh, Patiala House Court.

This new set of proceedings have taken his custody case to the Delhi High Court in the form of a Habeas Corpus Petition.

Meanwhile, Bhardwaj's supporters gathered outside the Parliament Street police station on Saturday. They demanded withdrawal of the case filed against him and alleged that it was an unfair investigation.

The case is related to an alleged attack that took place during a student protest at Jantar Mantar. The incident has sparked a broader political debate about the confrontation and the injuries sustained during it.

The Delhi Police has denied that the victim had a severe injury to her skull, saying that it is investigating the allegations.

The High Court hearing on Monday will be focused on the habeas corpus petition filed against Bhardwaj's arrest.
