Hyderabad: The PIL Bench of the AP High Court comprising Chief Justice Kalyan Jyoti Sengupta and Justice P V Sanjay Kumar on Monday made it clear that the government cannot assign public lands to political parties at throwaway prices.
“It is the law that the government can only alienate lands by public auction and by ensuring that the best offer comes to the exchequer,” the Bench said, while dealing with a writ petition filed by one
V Gopi Krishna.
The petitioner challenged the action, on the part of authorities, in alienating Ac.0.97 cents of land in East Gudur village of SPSR Nellore District in favour of the Congress party as illegal and unconstitutional. It outrightly rejected the respondents’ plea that similar lands were given to other political parties.
Further, dubbing such action as ‘peaceful co-existence’ between political parties, the Bench called for a list of such beneficiaries and directed the matter to be listed on Wednesday. The petitioner sought a direction to term the Government Order issued in February 2009 as illegal. He also sought a consequential direction that the Rythu Bazaar to be constructed at the place.
