Hyderabad: Former Chief Minister N Kiran Kumar Reddy, who has been wavering on the issue of floating a new political party, on Tuesday took to legal battle, opposing the manner in which the Union government had bifurcated the State.

Kiran Kumar Reddy filed a petition in the Supreme Court, alleging that the Centre had divided the State in gross violation of Constitutional provisions.

Though in the past many people including leaders of TDP and other organizations had filed petitions in the apex court, they were disposed of by the Supreme Court, asking them to approach them at an appropriate time. Kiran after consulting legal experts both in the State and in New Delhi decided to file the petition since the process of bifurcation has been completed and the gazette notification has been issued.

It is learnt that Kiran has taken objection to introduction of the T Bill in Parliament even though the State Assembly rejected it. He is also said to have stated that making Hyderabad as the common capital for both the States without amending the Article 371-D was yet another violation of the Constitution. The petition, it is said, also referred to the problems that would arise in sharing of water and power.

However, it remains to be seen if the apex court can strike down a legislation that has been passed by Parliament. If this happens, it could lead to a new controversy between the legislature and the judiciary.
