A two judge bench of the High Court at Hyderabad on Friday issued notices to the Central government to respond to a petition on the Mines and Minerals (Development and Regulation) Amendment Ordinance, 2015. The bench comprising Chief Justice Kalyan Jyothi Sengupta and Justice PV Sanjay Kumar was dealing with a writ petition filed by M/s My Home Industries Ltd for prospecting licenses in Kurnool District for Limestone in accordance with the Principal Mines and Minerals (Development and Regulation) Act, 1957 as available prior to the issue of the 2015 Ordinance.

Counsel for the petitioner Sivaraju Srinivas said that the company had applied for different prospecting licenses, in 6 different parcels of land, situated in Banaganapalli Mandal Kurnool District, in order to feed his M/s Sree Jayajothi Cements Ltd in the district. After the amended Ordinance, all the applications were ineligible causing loss to the company. The bench directed the Central Government to first consider the pending application of the petitioner as per Act of 1957 and granted it time to file its counter.
