Dismissing Public interest litigation filed against the land pooling and environmental issues of taking away fertile land for capital construction, the Supreme Court Judge H L Dattu said the court will not intervene in the issue of capital formation as it is a state subject.


The judge justice said such problems of land use were common in the building of new capital cities. Loss to some could be gain to others, particularly to people he said adding that the State Government was the final authority.


Rejecting the contention of the PIL petitioner the court said that environmental clearance was not necessary at this stage of new capital plan and that no capital was built in the country against environmental norms in the country.
