Hyderabad: A two-judge bench of the High Court at Hyderabad comprising V Ramasubramanian and Justice Anis on Tuesday directed the NTR University of Health Sciences at Vijayawada and Kaloji Narayana Rao Health University in Warangal to treat one seat out of three seats in Oncology Super Speciality as unreserved under the Presidential Order and further directed the authorities to allot it to the petitioner, who is a first ranker in the entrance test conducted for the admission into the course.

The bench made the order, while allowing a writ plea filed by Dr Phanindra Kumar Nagisetty, questioning the action of the NTR University in not accepting his application for the course along with several other aspirants from non-Osmania University area.

The petitioner also questioned the action of the Kaloji University reserving all the three seats in the DM/ MCH (Surgical Oncology) course only to applicants from Osmania University as illegal. C V Sumon, counsel appearing for the petitioner, submitted that the Telangana region had only one seat during the combined AP and after the bifurcation of AP, the Telangana got two additional seats after the bifurcation and it would be justifiable if the Kaloji Varsity and the Telangana State government to treat one seat as unreserved.

Opposing the writ plea the Additional Advocate General J Ramachandra Rao pointed out that that after the bifurcation of the AP, both the States have right to act independently as per the Article 371(D) of the Constitution.

Speaking for the bench, Justice Rama Subramanian referred to Section 95 of the AP Reorganisation Act 2014 and said that admissions has to be provided for the students of combined State for a period of 10 years in both States.
