Andhra Pradesh Chief Minister N Chandrababu Naidu\'s petition seeking quashing of the order of the Principal Special Judge for ACB cases, Hyderabad, who had referred the private complaint filed by YSRCP MLA A Ramakrishna Reddy to the police for investigating the role of Naidu, came up for admission in the High Court at Hyderabad on Thursday. 

Hyderabad: Andhra Pradesh Chief Minister N Chandrababu Naidu's petition seeking quashing of the order of the Principal Special Judge for ACB cases, Hyderabad, who had referred the private complaint filed by YSRCP MLA A Ramakrishna Reddy to the police for investigating the role of Naidu, came up for admission in the High Court at Hyderabad on Thursday.

Justice M S K Jaiswal allowed the petition filed by Naidu seeking dispense with the filing of certified copy of the private complaint by Ramakrishna Reddy and ordered that the matter will be heard in detail on Friday.

Chandrababu Naidu in his petition to the High Court attacked the Special Judge saying he “acted with undue haste and contrary to judicial propriety though he has no jurisdiction either to entertain the complaint or to refer the same to the police for investigation” in view of the finding by the High Court in a quash petition filed by one of the accused that Prevention of Corruption Act has no application to the facts and circumstances of the case.

He said the order is contrary to law and reflected non-application of mind in reference to the facts of the case. Naidu denied all the allegations made against him by the complainant and charged that “the complaint is solely intended to embarrass, harass and in a mala fide manner wreak political vengeance against him as the complainant belongs to the opposition party.”

He also questioned the locus of the complainant saying that he is neither a victim nor an aggrieved person to the crime which is registered in the state of Telangana and was connected with the election to the Legislative Council of that State. Naidu asserted that both the complaint and the impugned order of the Principal Special Judge are an abuse of process of law and court.

Naidu referred to the allegations made against him by the Respondent YSRCP MLA that he was a conspirator of the alleged offering of money to nominated MLA Stephenson and stated that the allegations were “vague, bald and unfounded”. He also pointed out that the order of the Special Judge directing investigation and report under Section 156(30 CrPC would result in an anomalous situation wherein after the filing of the charge sheet on 22-07-2015 there would be a second FIR being registered with respect to the same matter.
