Hyderabad: Former chief secretary of Andhra Pradesh I Y R Krishna Rao advised Chief Minister N Chandrababu Naidu to realise that cherry picking the officer of choice for the post of director general of police (DGP) will not stand to legal scrutiny even after the amendment to the Police Act to facilitate this exercise.

In a letter to the Chief Minister, Krishna Rao said that the Supreme Court in a judgement in the Prakash Singh vs Union of India case, issued some guidelines to be operative till the new legislation is enacted by the state governments.

Accordingly, the Supreme Court laid down the guidelines covering the issues like setting up of the Security Commission, procedure for selection of DGP, separation of investigation from Law and Order and establishment of the Police Complaints Authority.

Krishna Rao said that any legislation in this regard should cover all these aspects of police administration and the state governments may not have the liberty of choosing to legislate exclusively for selection of the DGPs .

The guidelines envisaged by the Supreme Court may be operational including the process for selection an officer for the post of DGP till such time a comprehensive Police Act is promulgated.

He suggested to the Chief Minister to go in for a comprehensive Police Act which can be a trendsetter for other states as well. The very spirit of the judgment was to make the police accountable essentially and primarily to the law of the land, the people and rule of law.
