HC: Online counselling for mgmt quota valid

Hyderabad: A division bench of the AP High court comprising Chief Justice Kalyan Jyoti Sen Gupta and Justice G Rohini on Tuesday declared that the online counselling for the management quota seats in the Engineering stream was not ultra vires and that it was lawful.
The bench, however, declared that the reduction of the quota of seats from 15 % to 5% in the NRI category was unconstitutional as it was contrary to the ruling of the Supreme Court. The bench also ruled that though the counselling is valid, applications in hard copies also can be received by the management of the private engineering colleges and that they too would be considered as valid applications. The bench further upheld the right of the private managements to interview the selected candidates to verify their financial viability etc.
The Chief Justice who ready out the order also pointed out that the management could also reject a particular candidate selected in the merit list but would record the reasons and communicate the same to the student and the AP State Council for Higher Education (APSCHE).
Dealing with the question of multiple options and the complaint of the private colleges, the bench said that there was reason in the plea that such a system would be impractical. The bench directed the APSCHE and the managements to confer , consult and find a solution by capping the number of alternatives a student can be allowed to make while making his application.
