HC rejects petitions against Transstroy

Hyderabad: Justice Naushad Ali of the AP High Court on Wednesday dismissed a batch of writ petitions challenging the Indrasagar Polavaram project to Transstroy-JSC EC UES. To the uninitiated SOMA-CGGC –JV, Ritwick Engineering and Madhucon had separately challenged the action of the state government in alloting the contract to Transstroy.

It may be recalled that the petitioners had questioned the construction experience of Transstroy-JC and even questioned the company’s claim of having made huge projects in foreign countries (Russia and China). The petitioners had alleged that the state government had initial conditions which were published at the time of inviting tenders were relaxed later on, and this vitiates whole tender process. The petitioners sought consequential cancellation of awarding of the contract and direct the state government to call for a fresh tender process by extending relaxation to all the prospective bidders for the Rs.4,717- crore Polavaram project. The judge observed that the action of the government in allotting the contract to the said company had saved Rs 600 crore.

"The Polavaram project has eluded the people so long for no fault of theirs and it cannot afford to wait longer. The project has been the people's dream for decades and it has been conceived with an avowed object of irrigating lakhs of acres of barren land by diverting water, which would otherwise go waste into the sea and to bring prosperity and happiness to millions of people", Justice Naushad Ali reasoned while dismissing the writ pleas.
