New Delhi: In a significant development in the law intern sexual harassment case, the Attorney General of India on Friday said prima facie retired Supreme Court judge Justice Asok Kumar Ganguly was guilty in the case, television reports said. Reports said A-G GE Vahanvati has sent his opinion on Justice Ganguly to the Union Law Minister.

The Home Ministry had referred a Presidential reference on the allegations against Justice Ganguly to the Attorney-General indicating that the government might remove him as the chairman of West Bengal Human Rights Commission. The move came after President Pranab Mukherjee referred to the Home Ministry a letter by West Bengal Chief Minister Mamata Banerjee seeking Ganguly's removal from the high post following a law intern's allegation of sexual harassment against the former judge and his refusal to quit the post.

"Papers have come to us. I can say as of now that we have sent to the legal department and then after obtaining their opinion, we will go ahead," Home Minister Sushil Kumar Shinde had said. Ganguly, who retired from the apex court more than a year ago, was accused by the intern of sexually harassing her in a hotel room in Delhi last year, a charge strongly denied by Justice Ganguly.
Additional Solicitor-General Indira Jaising had also written to Prime Minister Manmohan Singh seeking Ganguly's removal. She had also written an article bringing out excerpts from the intern's statement before the Supreme Court panel. Ganguly had questioned how the confidential statement made by the young woman has been made public.
