BJP Wants Top Courts To Establish Guidelines For Filing PILs. The Bharatiya Janata Party (BJP) on Saturday supported Finance Minister Arun Jaitley\'s statement that public interest litigation (PIL) activists must declare their details in a manner similar to the affidavits filed by public representatives and said the top courts must establish guidelines about the same.

New Delhi: The Bharatiya Janata Party (BJP) on Saturday supported Finance Minister Arun Jaitley's statement that public interest litigation (PIL) activists must declare their details in a manner similar to the affidavits filed by public representatives and said the top courts must establish guidelines about the same.

"I think the suggestion from Finance Minister Arun Jaitley is a very welcome suggestion. Just as public representatives who fight elections have to disclose in affidavits all their details including their background, education and income and assets details, activists who file Public Interest Litigations should also disclose all their details," BJP spokesperson GVL Narasimha Rao told ANI.

Raising doubts on the motives of the PIL activists, Rao said the top courts should establish guidelines for the filing of PILs and transparency about the motives of the activists .

"The country needs to know if indeed it is the public interest that motivates such people or is there a private and commercial interest involved. When such transparency comes about a lot of doubts about these so called activists will be cleared. I certainly hope that the Supreme Court and the High Courts where the PILs are filed will the formulate guidelines in this regard," he added.

Meanwhile, senior advocate H.S. Phoolka said that some people misuse the PIL facility but that does not mean that all the people who file PILs are wrong.

"These people are also citizens of the nation on whom the normal law applies. Should we punish these people who file PILs for the benefit of the public? Delhi has received CNG because of PIL and the FIR that was registered for the missing children case came through a PIL," Phoolka said.

"All these people and trusts have to file Income tax returns; foreign funds also have to file annual returns. It seems that this government wants a free hand and it wants to discourage these social activists. If this continues then we are headed towards a dictatorship," he added.

Union Finance Minister Arun Jaitley had said all those filing Public Interest Litigations (PILs) against developmental projects should declare their source of funding for the sake of transparency.

Jaitley had also said that the institution had to go through hurdles posed by PIL while setting up Gujarat International Finance Tec-City (GIFT).
