2013 hate speech at Nirmal

Hyderabad: Even after elapsing of 34 months of registering an FIR against Majlis-e-Ittehadul Muslimeen (MIM) floor leader Akbaruddin Owaisi alleging that he had delivered a hate speech at Nirmal town in Adilabad, the police have failed to file a chargesheet till date.

According to law, if the police fails to file a chargesheet in the court within a span of 36 months from the date of registration of the FIR, the accused can file a discharge petition in the court under Section 468 of the CrPC.

The latest status of the case has come out when an activist filed an application with the Adilabad District Court under the Right to Information (RTI) Act.

Political observers feel that the government is perhaps facilitating such a move since the AIMIM happens to be an ally of the TRS and also in view of the forthcoming GHMC elections.

It may be mentioned here that a suo motu FIR was registered against Akbaruddin Owaisi in the Nirmal police station on January 2, 2013.

Akbaruddin had addressed a public meeting attended by about 25,000 people in December 2012 where he had allegedly made defamatory and derogatory comments against people of a specific community.

He has been facing charges of sedition and waging war against the nation among others, under relevant Sections of the Indian Penal Code (IPC) in two different courts in Adilabad and Nizamabad districts.

On January 8, 2013, the Hyderabad police arrested Owaisi from Gandhi Hospital in Secunderabad when he tried to skip the court proceedings on the grounds of ill-health and produced him in the court.

After spending 40 days in prison, Akbaruddin received bail on February 15, 2013 citing health grounds. Later, he attended the court proceedings in Nirmal.

When M Srinivas sought to know from the authorities using the RTI Act about the progress of the case, it has come to light that things did not move forward during the last 34 months.

Srinivas had filed an RTI application referring to crime number 0001/2013 registered at the Nirmal police station, the Assistant Public Information Officer at the District Court of Adilabad replied that the court did not receive any chargesheet till September 29, 2015.

Inquiries made by The Hans India also indicated that till date, no chargesheet has been filed. Though another RTI petition was filed with regard to the progress of the Nizamabad case, the petitioner had not received any reply so far.

As part of the investigation, the police collected various video and audio clippings of the speech given by Owaisi at Nirmal and also recorded his voice in presence of the Magistrate at Nirmal.

When asked about the delay in filing the chargesheet, the investigating officer Purshotham said that they had sent the tapes to the Central Forensic Laboratory at Chandigarh for examination on February 2013.

They are yet to get a report from the lab and hence the delay in taking the case forward, he added.
