BENGALURU: The high court has brought relief to a Bangalorean who was being prevented by the police from selling his Audi car, as it was cited that the woman from whom he had purchased the particular car, was involved in a fraud of worth Rs 375 Crore.
V Jayakumar had approached the court challenging the September 27 order of the RTO on the instructions that have been issued by the police attached to the economic offences division. The order had blocked all entries and details regarding the Audi A4 2.0.
Police had said that the car was the property of Disha Choudhary, who is a realtor accused of cheating 3,520 customers to the tune of Rs 375 crore. The CID is currently investigating the case, so there is nothing wrong with blocking the details about the car, the cops had contended.
The court has ruled that the police cannot restrain a sale or alienation of any vehicle under the section 91 (1) of the Criminal Procedure Code (CrPC), 1973. It has directed the regional traffic officer (RTO), located at Electronics City, to remove the block that is imposed on the records and entries of the car in the official computer system
“Going by the text of section 91(1), what one can infer is that the court or jurisdictional police can seek production of any document for the purpose of investigation, trial or any proceeding under the code,” Justice Krishna S Dixit observed in his order.
He noted that the opinion of the court is necessary for the production of the vehicle. Otherwise, there are risks of invalidation based on the grounds of abuse of power or casual approach of the authority.
