The newly elected government will soon take over in Jammu & Kashmir. The people of this troubled State displayed their commitment to democracy by participating in a big way in the multi-phase polls. Notwithstanding the new political arithmetic that emerged after the verdict, now is the time to find a coherent and rational solution to the vexed Kashmir problem. It is not just a territorial dispute between India and Pakistan. It is a test for India’s commitment to secularism and federalism. Therefore, a solution to Kashmir imbroglio should encompass adherence to historical commitments by appreciating the facts of history, undiluted commitment to unity, integrity and sovereignty of India and a pragmatic reappraisal of contemporary reality.

Any such policy should unequivocally reiterate that Kashmir’s accession to India is complete and irreversible. Jammu & Kashmir is an integral part of India. There is no room for outside mediation on this. Therefore, a plebiscite or redrawing its boundaries is neither practical nor permissible in today’s context. But, this should not make us oblivious to the historical circumstances in which this region acceded to India. The people of Kashmir fought the Pakistani raiders, the local king who displayed independent ambitions and voluntarily chose to become part of India. When the nation was bleeding due to communal carnage on the eve of partition, people of Jammu & Kashmir demonstrated an exemplary communal harmony. This speaks of the significance of Kashmiriyat, the unique Kashmiri identity. The Article 370 of Indian Constitution is a recognition of these historical commitments. India is committed to special autonomy for this State. But, successive governments diluted this key constitutional provision, leading to alienation of people. Precisely, fundamentalists and terrorists sponsored from across the borders have capitalised on this discontent and a sense of alienation among the people of Kashmir valley. Therefore, restoration of maximum autonomy within the framework of the Constitution and Indian sovereignty should form the core of any such policy on Kashmir.

The State of Jammu & Kashmir has three distinct regions – Jammu, Kashmir and Ladakh – which have distinct geography, culture and demography. Recognising this, regional autonomy should be granted to these regions within the framework of overall autonomy. In fact, such a policy should be a prelude to radically restructuring Centre-State relations in India in the true spirit of federalism. Special needs of Jammu region should be addressed. The dignified return of Kashmiri pundits to the valley should be an integral part of this Kashmir policy.

The Centre should take liberal and proactive steps to revive the economy pillaged by decades of insurgency. Negotiations should be held with everyone concerned without any inhibitions. People-to-people contacts, trade and cultural relations across the LoC should be encouraged. India should work for a comprehensive dialogue with Pakistan covering all outstanding issues along with Kashmir and cross border terrorism. Let’s seize this opportune moment to find an enduring solution.
