A two judge bench of the High Court at Hyderabad comprising Justice R Subash Reddy and Justice C Praveen Kumar on Tuesday set aside an earlier order directing the State government to allot alternative land to provide house sites at Nizampet village in Ranga Reddy District.

The bench was dealing with a review petition filed by the Telangana State government. An earlier bench had directed the State government to allot alternative lands to 465 persons at the rate of 60 square yards each in the said village, so that they could have alternative means for shelter.

Advocate General K Ramakrishna Reddy informed the court that the Tahasildar of Qutubullapur mandal had issued the land in spite of there being a ban on issuing of house sites in the limits of Hyderabad Urban Development Authority. He said disciplinary action against the Tahasildar was initiated.

“As it is stated that even among the applicants, the claims of those who are eligible as per the notified norms of the government for grant of flats under scheme of Rajiv Gruhakalpa will be considered, this Court is of the view that the order under review, which directs for taking steps for grant of possession or to give alternative land, is fit to be set aside,” the bench said and set aside the earlier order.
