Hyderabad: All the police stations which have been strictly following the Supreme Court (SC) guidelines with regard to the right of the police to sanction ‘station bail’ to accused are facing backlash by the State Commission for Women (SCW).Police, on the other hand, say that they are helpless and maintain that they are just following the guidelines in the CrPC Amendment Act-2010.


Recently, the apex court implemented Section 41 of the CrPC Act 2010 and gave the right to the police to sanction bail to accused. “Courts are repeatedly asking us to sanction bail to the eligible at the police station level itself, instead of producing them before courts,” said a police official.


The police say that instead of accusing them, public should have knowledge of the apex court guidelines. But the women’s organisations in the city came down heavily on the recent move by the Supreme Court. “Accused getting bail at the police stations is not acceptable.


Even cops should come out of the lethargic attitude while dealing with victims of rape, molestation and assault,” they said. “They sometimes not only refuse to register a case but also try to browbeat the victim. Cases related to rape need to be expedited and an exemplary punishment must be given to them so that it acts as a deterrent for those who indulge in such heinous crimes,” chairperson, CWC Dr Tripurana Venkataratnam said adding that if station bails were given at the police station level, the culprits would have no fear of law and thus the impunity would certainly embolden the culprits.


Police have begun strictly exercising their right to sanction bail to the accused in cases in which imprisonment could be below seven years, based on the apex court guidelines. “We are conducting a national level meeting on the SC judgment in the case Arnesh Kumar Vs State of Bihar,” the chairperson added. The guidelines of the 2010 Act were basically to save the time of courts. It was also made mandatory for the police to maintain a record of reasons for both making and not making an arrest of the accused.
