New Delhi: The Supreme Court here on Wednesday vacated the status quo order on the appointment of civil judges in the two Telugu States, and thus effectively paving the way for not only recruitment of the judges but also allowing candidates to opt for the States they belong to or wish to serve.
The three-member bench headed by Chief Justice Justice T S Thakur ruled that there was no need for the stay to continue on the appointments and the governments could go ahead with their proposals.
The status quo was ordered when a former judge of a civil court D Dharma Rao had approached the apex court ahead of bifurcation in 2014 seeking a stay on the appointments. The judgement that was delivered on July 7 last year ordering a status quo effectively put a stop to the new appointments.
The High Court had in fact approached the Supreme Court to reconsider its decision as the work in judiciary would suffer because of the same.
The apex court in turn said there was no stay on promotions and the High Court could go ahead with the same.
While senior advocate P P Rao represented the AP government, senior advocate Ramakrishna Reddy appeared on behalf of the Telangana State and advocate Anamika represented the petitioner Dharma Rao who had retired since.
