Counsel for the petitioner Raghunath submitted to the Court that as per the Criminal Procedure Code, it is mandatory on the part of the government to order a judicial inquiry if a person dies in police custody. The Telangana government counsel contested this submission saying that Banappa died due to choking and it was not a custodial death. The judge ordered the State of Telangana to file a counter affidavit and posted the matter to January 21, 2016.
