Govt told to file counter in custodial death case
Justice Sanjay Kumar of High Court at Hyderabad directed the State of Telangana to file a counter affidavit relating to the custodial death of Banappa in West Marredpally police station on the night of August 3, 2015. The Judge was hearing a writ petition seeking institution of judicial inquiry into the death.

Counsel for the petitioner Raghunath submitted to the Court that as per the Criminal Procedure Code, it is mandatory on the part of the government to order a judicial inquiry if a person dies in police custody. The Telangana government counsel contested this submission saying that Banappa died due to choking and it was not a custodial death. The judge ordered the State of Telangana to file a counter affidavit and posted the matter to January 21, 2016.
