Hyderabad: The High Court of Judicature at Hyderabad asked the Telangana state police to expedite the process of filing chargesheet against MIM MLA Akbaruddin Owaisi in the hate speech case filed by the Adilabad police.

Hearing a petition seeking direction to the police to register an FIR, a Division Bench of the court comprising acting Chief Justice Dilip B Bhosale and Justice S V Bhatt questioned the government pleader as to how much time the police take to file the chargesheet.

The Bench was informed that cases have been filed against the accused under Sec 153A of the Indian Penal Code but he is a legislator and the police needed sanction from the government to proceed.

The Bench sought to know from the government pleader why the government was delaying in giving sanction and directed to inform the status by next week when the case comes up again.It may be recalled that suo motu FIR was registered against Akbaruddin Owaisi in Nirmal police station on January 2, 2012. Akbaruddin had addressed a public meeting attended by about 25,000 people in December 2012, where he made defamatory and derogatory comments against the people of a specific community.

He has been facing charges of sedition and waging war against the nation among others, under relevant sections of the Indian Penal Code (IPC) in two different courts in Adilabad and Nizamabad districts. On January 8, 2013, the Hyderabad police arrested Owaisi from Gandhi Hospital in Secunderabad and produced him in the court.

After spending 40 days in prison, Akbaruddin received bail on February 15, 2013 citing health grounds. Later, he also attended the court proceedings at Nirmal. The police had already sent various audio and video clippings of the meeting addressed by Owaisi and his voice sample to Central Forensic Laboratory at Chandigarh in February 2013.
