Justice B Shiva Shankara Rao of the High Court of Judicature at Hyderabad on Friday quashed criminal case against Jerusalem Mathaiah in controversial cash-for-vote-scam. It may be recalled here that on the eve of elections to Legislative Council in May last year, there were allegations that money was offered to Anglo-Indian MLA Elvis Stephenson. 

Hyderabad: Justice B Shiva Shankara Rao of the High Court of Judicature at Hyderabad on Friday quashed criminal case against Jerusalem Mathaiah in controversial cash-for-vote-scam. It may be recalled here that on the eve of elections to Legislative Council in May last year, there were allegations that money was offered to Anglo-Indian MLA Elvis Stephenson.

The petitioner Mathaiah was arrayed as one of the accused. Keeping in view of the delicate situation, the Chief Justice had permitted court to conduct proceedings through videoconferencing.

Only advocates on file were allowed into the court hall during the proceedings. In his 75-page judgement, Justice Rao noted that there were no details in the complaint made by Stephenson, who alleged that TDP leader Revanth Reddy had offered money.
He pointed out that the complainant had failed to point out bare details as to who came.

“Even before registering the case, gathering of evidence, investigation by recording, etc., was done. The preliminary inquiry before registering the crime was not in accordance with law.

The judge found fault with the manner in which the investigation was carried out. “The ends of justice will be met if proceedings against the petitioner are quashed,” Justice Rao said and quashed the proceedings against Mathaiah only.
