Hyderabad: The High Court at Hyderabad on Wednesday directed the Andhra Pradesh government to treat Intermediate as ‘qualifying examination’ and not Eamcet for the purpose of defining who would be preferred for the 1 per cent NCC quota while selecting students for MBBS seats.

A division bench comprising Justice V Ramasubramanian and Justice Anis gave this interim order while hearing a petition filed by R Jotsna of SPS Nellore district seeking directions to the state of Andhra Pradesh for declaring a part of the GO MS No 111 as illegal since it is adversely affecting scores of other students.

The Andhra Pradesh government issued the GO on September 3, 2015 wherein Eamcet was defined as 'qualifying examination'. The GO 111 was challenged earlier too.

The High Court had then directed the AP government to scrap it altogether as it contained several contradictions and bring out a new GO in tune with the NCC Directorate’s latest norms. But this was not complied with.

The division bench found fault with the authorities of AP’s Department of Health, Medical and Family Welfare for giving wrong interpretation to the expression -- 'qualifying examination' and made it clear that ‘qualifying examination’ means Intermediate examination and not Eamcet.

The authorities had stated that all those who obtained NCC A, B and C prior to their appearing for the qualifying examination, that is Eamcet, will be given priority.

The bench wondered how qualifying exam could be interpreted as a competitive exam and directed the AP authorities to give priority to those students who have obtained NCC A, B and C certificates prior to their appearing for Intermediate exam and not to those who have obtained the certificates prior to Eamcet.
