The division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice Shameem Akhter heard the PIL filed city based advocate M Govinda Reddy. The counsel for the petitioner informed the bench that since test match would be held on February 9 it was necessary for the court to appoint an administrator till the new body is elected as per the recommendations of Justice Lodha Committee.

He pointed out that the BCCI had appointed international audit firm Deloitte to conduct a forensic audit into HCA accounts as there were many allegations of fraud and misappropriation. The audit firm found many incriminating evidence of fraud and misappropriation against the office bearers of HCA, many of who are currently facing ACB cases.

The counsel also submitted that as per Lodha Committee recommendations, a new elected body should have been in place by September 2016, but till date there was no such body. Many of the office bearers of the previous body were facing allegations and had to demit office, including the previous president of the HCA.

He said the Lodha Committee in its recommendations made it clear that the persons facing criminal charges shall not be eligible to hold the posts of office bearers of Cricket Associations. He pointed out the strange situation in HCA with both the President and Secretary being mired in charges of corruption and therefore stepping down, leaving the body headless.

Since the test match is nearing, there is an urgent need for the Court to appoint an officer to run the affairs of HCA till a new elected body is in place.

The counsels for the Respondents objected to the maintainability of the PIL on the ground that the petitioner was currently working as Government Pleader in the State of Telangana and he has no right to file a Public Interest Litigation. The bench will continue its hearing in this case on Friday.
