Hyderabad: Officers working in the Secretariat have come united under the banner of Telangana BC and OC Employees’ Rights Protection Committee against the present practice of reservations adopted by the government for the benefit of ScheduledCates and Scheduled Tribes. The government provides quota for SCs and STs at the rate of 15 per cent and 6 per cent respectively.

The main contention of the Committee is that the BCs and OCs have been denied promotions because GO No. 26 was issued by the Social Welfare Department contrary to the established procedure. As the GO was issued by the Social Welfare Department instead of General Administration Department, majority of Additional Secretaries, Joint Secretaries and Deputy Secretaries and Assistant Secretaries were now filled with SC and ST officers and it led to denying due promotions to BC/OC communities. This discrimination was due to wrong interpretation of rules.

This was challenged in APAT which hadquashed the GO MS no 26 and directed the government in its order dated August 12, 2015 in O A 6563/2011 to stop from counting the seniority of the reserved category from the date of their promotion and the senior general candidates if later reached the promotional level would regain seniority, but it was not implemented till date.

The Supreme Court in various judgements in CA No, 2368 of 2011 in B K PavitraVsUnion of India and in CA No. 6631 /2015 in S Paneer Selvam and the government of Tamil Nadu has reiterated providing consequential seniority under section 3 and 4 to persons belonging to SCs and STs on promotion against roaster points to be ultra vires under Articles 14 and 16 of the Constitution. The judgement will not affect those who have already retired and will not affect financial benefits already taken.

The Telangana Secretariat BC and OC Employees Rights Protection Forum met Chief Minister K Chandrashekar Rao and the Chief Secretary S P Singh and requested them not to effect promotions to the SC and ST employees in all categories of Secretariat in the DPC to be conducted shortly based on the provision of consequential seniority as there is no provision for consequential seniority in the general rules,i.e. AP State and Subordinate Service Rules 1996 and review all the panels effected w.e.f. 2003 to till date and do justice to other category employees duly placing such eligible candidate in their respective places.
