On Thursday, the Supreme Court said that there won’t be any interference with the earlier direction to Hyderabad High Court to complete judicial officers appointment for Telangana state and Andhra Pradesh within six months.


Chief Justice H.L. Dattu along with Justices Arun Mishra and A.K. Sikri were the three-judge bench who said bifurcation of judicial cadre may be made once officers were selected and exercised their option.


There was no hindrance to go ahead with the judicial officers promotions for the Hyderabad High Court said the Supreme Court. Appearing for Telangana, Attorney-General Mukul Rohatgi put forward before the bench that although the commencement of the appointment process on January 20 was directed by the court, the appointments cannot be made unless the Telangana is put in place a separate judicial cadre.


Stating that recruitments cannot be done in the air, Mukul Rohatgi said that the state must be aware of the requirement of the judicial officers to be recruited and that can be done after calling for option from the candidates. He said seeking clarification of the January 20 order; the state had filed the present application.

The state in its application said for filling the posts of judicial officers without consulting it and without planning the State-wise cadre strength, the High Court issued a notification on February 5. Also, Articles 233 and 234 of the Constitution needed that judicial appointments should be done state-wise and, therefore, notifications for judicial officers’ appointment must be issued separately for AP and Telangana.
