HC to decide on permission to T JAC martyrs yatra on Monday

Hyderabad: The High Court at Hyderabad has observed, as its primary view, that the reasons shown by the Telangana police in cancelling the permission for Martyrs Yatra of Telangana Joint Action Committee (T JAC), scheduled to be held on October 21 and 22, seem to be not proper. It asserted that it would itself decide on granting of permission for the next dates of yatra as also the conditions to be imposed. The court also directed the Telangana police to submit details of the preemptive arrests made at various places.

Justice S V Bhatt gave these directions, while hearing a petition moved by T JAC Co-Convenor Gopal Sharma, seeking a direction to the Police to give permission for the yatra. The petitioner had complained that although the application for permission was submitted much earlier, the police had kept it aside and not acting on it.

The counsel for the petitioner B Rachna Reddy informed the judge that the police on Friday declined permission for the yatra in Nalgonda and Suryapet districts, and sought clarifications in regard to yatra in Yadadri and Bhuvanagiri. This was intentional, and the reasons stated for rejecting the permission were fictitious ones like scope for clashes, entry of antisocial elements in the yatra, etc.

The judge suggested that in light of permission denied at the last moment, the prayer sought in the petition needed to be changed to challenge the grounds for rejection of permission instead of seeking a direction to the police to act.

Telangana Additional Advocate General J Ramchandra Rao submitted that in the earlier yatras undertaken by the TJAC, it had flouted the conditions imposed by the police. He also said the TJAC leaders had never submit route maps while it is essential for the police to take precautions to prevent clashes.

The judge remarked that the State should keep in mind that every citizen of the country has a right to express his dissent. He also asserted that the Court would take the responsibility of balancing the need to maintain law and order and the citizen’s right to express dissent. He said the court would decide on the permission for the yatra in the next dates and as to what conditions need to be imposed. The judge also directed the Telangana police to place before court the details of the preemptive arrests made in this regard and adjourned the case to Monday.
