Hyderabad: Khairatabad MLA Danam Nagender has moved the Supreme Court challenging the Telangana High Court’s order disqualifying him under the anti-defection law. It may be recalled that Nagender, after the High Court verdict on Friday and again on Saturday morning, had said that he would not approach the Supreme Court. However, in a sudden turn of events, his legal team filed a petition before the apex court on Saturday afternoon.
The matter is expected to come up for hearing on Monday. Nagender has sought a stay on the High Court’s order and the consequential declaration of the Khairatabad Assembly seat as vacant.
The Telangana High Court on Friday disqualified Nagender under the anti-defection law in connection with his decision to contest the 2024 Lok Sabha elections on a Congress ticket while serving as a BRS MLA.
The court’s order also set aside the decision of Assembly Speaker Gaddam Prasad Kumar on petitions seeking Nagender’s disqualification.
Nagender’s lawyers had sought a stay on the High Court verdict and time to approach the Supreme Court, but the High Court declined both requests.
Following the development, Nagender’s legal team filed a Special Leave Petition (SLP) before the Supreme Court on Saturday. The petition seeks a stay on the implementation of the High Court’s order and on the declaration of the Khairatabad Assembly seat as vacant.
Legal sources said the petition is likely to be taken up by the Supreme Court on Monday. The proceedings are being closely watched by political parties in Telangana, with the BJP and BRS also stepping up their preparations following Nagender’s decision to challenge the verdict.
The BRS and BJP have already filed caveat petitions separately in the Supreme Court, anticipating that Nagender might challenge the High Court order.
The Supreme Court’s decision on the SLP could determine the immediate status of the Khairatabad Assembly seat and the next course of action in the case.
