RECUSAL OF JUDGE

Hyderabad: Justice B Siva Shankar Rao of the High Court at Hyderabad on Friday, said he would consider the opinion of the Advocate General of Telangana on the question to the judge to recuse himself from the bail petition filed by Jerusalem Mathaiah, one of the accused in the cash-for-vote scam.


K Ramakrishna Reddy, Telangana Advocate General said that there were many instances when a judge recused himself from hearing a petition if one of the parties had some doubt regarding unbiased judgement. It may be recalled that TRS MLA Elvis Stephenson requested the judge to recuse himself from hearing the bail petition.

Though the Advocate General refused to give his opinion in the matter, he said there were many instances when a judge recused himself even if one of the parties involved felt that there was a chance of a biased judgement. The judge told the Advocate General that he has taken note of the submissions and the implicit message and said that he will consider this while delivering the orders on Monday on recusing petition.
