AP Deputy Chief Ministers illogically submitted Memo to the Governor on 3rd August 2014 protesting for the constitution of the Telangana State Council for Higher Education (TSCHE) and urging Governor to Resolve Fees Reimbursement.

It is the prerogative of Telangana State to constitute TSCHE which is not violating any law. U/s 75 of the Andhra Pradesh Reorganisation Act, 2014 (APR Act, 2014) APSCHE shall function from Hyderabad for the period of 10 years from the appointed day and it shall provide facilities to the students of Seemandhra and Telangana State in the professional Colleges under its jurisdiction including the Quota of Seats in the limits of GHMC.

Whereas EAMCET or any other entrance examination is not mentioned under the APR Act, 2014 that means Quotas will remain for 10 years even if EAMCET is abolished.

Andhra Pradesh State is deliberately avoiding EAMCET Admission process of the Seemandhra Students in the name of Fees Reimbursement and putting blame on Telangana State. Whereas AP State could have completed EAMCET Counselling within its Quota as mandated U/s 95 of APR Act, 2014. Even Governor and Central Government is Powerless as on today to direct/instruct Telangana Government to extend fees reimbursement to Seemandhra Students. Section 95 of the APR Act, 2014 is reproduced below :

Section 95 : In order to ensure equal opportunities for quality higher education to all students in the successor States, the existing admission quotas in all government or private, aided or unaided, institutions of higher, technical and medical education in so far as it is provided under article 371D of the Constitution, shall continue as such for a period of ten years during which the existing common admission process shall continue.

Seemandhra or other States Scheduled Castes (SC) and Scheduled Tribes (ST) Students or their descendents residing in Telangana State on or after 1st November 1956 are not eligible for Fees Reimbursement due to Restriction imposed by the Articles 341 & 342 of The Constitution of India.

SC & ST students belonging to other States including AP are atleast lucky since T State generously extended the cut-off Date to 01.11.1956 compared to other majority of States where cut-off date is 1950.

BJP & TDP can Amend both the Articles 341 & 342 of The Constitution of India by inserting clause namely :

Members of castes and tribes included in the list of Scheduled Castes and Scheduled Tribes who migrated to other states and domiciled for minimum 14 years in the migrated state, but whose castes are not included in the schedule of the State to which they have so migrated, and the descendents of such members shall also be deemed to be members of “Scheduled Castes and Scheduled Tribes” of the migrated State;

The above clause may be passed in the Both Houses of Parliament without mentioning States of Andhra Pradesh and Telangana to avoid nationwide agitations by SCs/STs in other states and inviting future trouble by the BJP at large.

As per U/s 95 of the APR Act, 2014 AP State has got quota for Seemandhra Students in the Professional Colleges within the jurisdiction of GHMC only hence AP State can complete the Admission process which has not been denied by Telangana State whereas Fees Reimbursement has to be paid by AP State only since Sections 75 or 95 of the APR Act, 2014 do not directly or indirectly mention about Fees Reimbursement.

Even if Fees Reimbursement is to be paid by Telangana State to the Seemandhra Students is mentioned in the APR Act, 2014 than also it will be restricted as stated above since Fees Reimbursement is provided to the underpriviledged SCs/STs/BCs whose annual income is less than Rs. 2 Lakhs.

BJP- TDP Leaders, AP State Ministers are unconstitutionally irrationally illogically making noise over Fees Reimbursement and diverting attention to blame T State and its CM KCR.
