The Petitioner Mugi Kanthamma questioned her non-selection to the post. It is pointed out that the requirements prescribed are that the lady worker and her husband shall be natives of the village even before the notification of the post.

The petitioner challenged the appointment of one Y Ramannama contending that the successful candidate had married a person and gone away to Orissa and on his death had returned to the village.

Accordingly she was disqualified and the authorities erred in appointing her. “In the absence of any prohibition of consideration and appointment of such persons they cannot be disqualified” Justice Reddy reasoned.

He pointed out that the terms and conditions have to be construed in a rational and reasonable manner instead of in a rigid and pedantic manner.
