In a press note here on Thursday, the Hijra Transgender Welfare Society said that the Union Ministry of Social Justice & Empowerment had tabled Transgender Persons (Protection of Rights) Bill, 2016, in Parliament in early August which was draconian and repressive in nature and institutionalises State-sponsored structural discrimination, exclusion and violence against transgender people at many levels.

If the Bill was passed in toto, it would be against the Supreme Court judgment in NALSA vs Union of India and a regression over its own earlier version released on December 26, 2015, and a reversal of Private Member’s bill of Tiruchi Siva i.e., the Rights of Transgender Persons Bill, 2014 (Bill No XLIX of 2014) which was unanimously passed by the Rajya Sabha.

Hijra Transgender Welfare Society has stated that it was legally tenuous and sketchy at many levels in so far as it attempts to circumvent and subvert many of the principles laid down by NALSA vs Union of India verdict and a vast section of the transgender community strongly denounces the 2016 Bill.
