Faizan Mustafa says the 2013 Bill bears no resemblance to the draft created by Varsity in 2011

Hyderabad: The Disability Rights Bill-2013 approved by the Cabinet bears no resemblance to the draft that was created by NALSAR University (in 2011 on the behest of Government of India) and that it is a breach of trust and is against the disabled persons, said Nalsar University Vice-Chancellor Faizan Mustafa here on Wednesday.

Pointing to the 2013 Bill he said that it explicitly permits discrimination against persons with disabilities. “The 2011 Bill takes everyone on board, in terms of widening the definition of ‘persons with disability’ and covers all workplaces, educational institutions, hospitals, and healthcare providers, government services, private organizations/bodies/societies but the 2013 Bill is not inclusive. The 2011 Bill is uploaded on the Ministry of Social Justice and Empowerment, but the 2013 Bill is not in conformity with the United Nations Convention on the Rights of Persons with Disability,” he said. The 2011 Bill envisaged an independent regulatory authority as well as specialised tribunals set up to redress the grievances of persons with disabilities and their families.

These chapters have been completely deleted from the present Bill. Prof Amita Dhanda who was a part of the drafting committee said that the draft was prepared after taking into confidence of different associations in all the states and was translated into 14 languages. Prof Faizan Mustafa urged all political parties to include disability rights in their manifesto in the election and work towards a robust inclusive law.

Students from Nalsar University and members from disability cells of other universities would be participating in a rally from SD Road in Secunderabad to Secretariat on Saturday to stall the Bill from being passed in parliament.
