Police to produce circumstantial evidence under Section-164
The case related to attack on YSRCP president YS Jaganmohan Reddy will be investigated under CrPC Section 164, to establish circumstantial evidences
Amaravati: The case related to attack on YSRCP president YS Jaganmohan Reddy will be investigated under CrPC Section 164, to establish circumstantial evidences. Since the victim Jaganmohan Reddy did not lodge a complaint or not cooperating with the police for further investigation, the police have decided to provide circumstantial evidence in the court under Section 164. In fact, Chief Minister N Chandrababu Naidu directed the DGP RP Thakur to take all the available evidence in this case and produce the same in the court to ensure justice to the victim Jaganmohan Reddy.
When Jaganmohan Reddy denied tocooperate with the police, the Chief Minister held a meeting with his cabinet colleagues, AG, CS and DGP at Undavalli on Friday. After taking suggestions from legal and political experts, Chandrababu Naidu took the decision and asked DGP to continue the investigation, till it reaches to a logical conclusion.
A senior minister, after attending the meeting with Chandrababu Naidu, said to this correspondent that government could not remain silentsince Jaganmohan Reddy was not cooperating with the police and investigating officials. He further added that if he would not support for investigation, then they would be responsible for any further developments in this case. Jaganmohan Reddy had to reveal all the truths behind the incident. Otherwise, he must cooperate with the investigating officials, the minister said. Another minister said that despite being a victim, Jaganmohan Reddy was not cooperating with the investigation officials, but accusing the AP police.
Meanwhile, a senior advocate and Vijayawada Bar Association former president S Krishna Murthy said that the police were not supposed to remain silent on any criminal cases by saying that the victim did not lodge the case. He said that any individual and witness could lodge complaint on behalf of the victim. Under this procedure, the police officials are going to take circumstantial evidence from all the available witnesses at the airport, where the incident was happened, he explained. Krishna Murthy further explained that the police will also need to submit the CCTV video footages and other digital evidence in the court, as per the law.
He said that, when the case will be under trial, the court could summon or issue warrant to Jaganmohan Reddy to explain what had happened to him during the attack. At that time also, if Jaganmohan Reddy did not wish to explain or want to let the accused go without any punishment, then he may not open his mouth against the accused, he observed.
At the same time, there was a possibility for giving punishment to the accused by the court based on the statements of eye witnesses, circumstantial and digital evidences to be produced by the investigative officials, Krishnamurthy informed. He further said that there were such cases in the past and courts gave sentences to the accused persons, even though both the accused and victims colluded.
