New Delhi: A two member bench of the Supreme Court headed by Justice A K Sikri and Justice R F Nariman on Friday clubbed the Telangana government's petition on allocation of fair share of Krishna Waters/reconsideration of the Brijesh Kumar Tribunal order with the pending petitions filed Maharashtra and Karnataka against reopening the case.

The Telangana government has said it faced the grim prospect of hardly any water reaching its borders from any one of the three arms of the river, namely Bhima, Tungabhadra or the main Krishna. As per the final award passed on December 2010, Andhra Pradesh is entitled to get 1,001 tmcft of water, Karnataka will get 907 tmcft and Maharashtra’s share is 666 tmcft.

This award is binding till 2050.The Telangana State government earlier had sought a reopening of the case for fair share of Krishna waters soon after it came to power. However, Karnataka and Maharashtra strongly objected to the same contesting the reopening of the five decade old dispute.

Arguing on behalf of the Maharashtra government, senior counsel, Andhyarjun, said the water allocation was over and hence the case cannot be reopened. Telangana State was represented by the senior counsel Vaidyanathan.

The apex court had earlier issued notices to all parties concerned on seeking their opinion on the maintainability of the Telangana State petition too. Despite objections from others, it allowed the petition by the government of Telangana State as "it could not close its doors" on the request.
