A two judge PIL bench of the High Court at Hyderabad comprising Acting Chief Justice Dilip B Bhosale and Justice P Naveen Rao on Monday dismissed two writ petitions complaining of the failure on the part of the M/s GSG Constructions Pvt to make constructions at the old Gandhi Medical College.
Hyderabad: A two judge PIL bench of the High Court at Hyderabad comprising Acting Chief Justice Dilip B Bhosale and Justice P Naveen Rao on Monday dismissed two writ petitions complaining of the failure on the part of the M/s GSG Constructions Pvt to make constructions at the old Gandhi Medical College.
According to the writ petitioners Chandra Kishore Jaiswal and another, the action of the government in entering into an agreement with the consortium of M/s GSG Constructions Pvt even though earlier lease agreement and development and management agreement for development and operation of urban entertainment centre project on November 6, 2006 was terminated and the land was resumed.
The property in question is prime property at Basheerbagh. The petitioners sought directions to the authorities to allot the same to any genuine persons by calling fresh notification for tenders under the supervision of the High Court.
The petitioners also prayed for directions to the authorities to initiate Revenue Recovery Proceedings against the said consortium for non-paying the due rental amounts of Rs 2,554.88 lakhs as on March 3,2012 and further due rental amounts from March 27,2014 till the date of resuming possession from the consortium.
The bench said that the writ petition was not maintainable in the form of a PIL at the instance of the petitioners since they had personal interest in the matter. In the meanwhile, the Telangana State government informed the court that it had already issued a notice to the said consortium and would take necessary action.
