The PIL bench of the AP High Court comprising Chief Justice Kalyan Jyoti Sen Gupta and Justice KC Bhanu on Tuesday appointed senior counsel S Ravi as amicus curiae in a writ plea seeking plebiscite on the State bifurcation issue. The bench is dealing with a writ plea filed by legal practitioner JP Rao seeking a declaration against the Centre’s decision to bifurcate the State.
The petitioner pointed out that the impugned action in the absence of eliciting the expression of the people of the State amounts to violation of the Constitution. The Centre had acted upon the resolution of the Congress Working Committee and got the same approved by the cabinet, he said. The present order came in the light of a spate of similar writ pleas being dismissed by the High Court. The court had repeatedly ruled that the issue is within the terrain of political decision making and in the present state not come up for judicial review.
