New Delhi: A bench of Supreme Court, consisting of Justice Gopala Gowda and Justice Arun Mishra, set aside the order of the High Court of Judicature at Hyderabad freezing the accounts of the Andhra Pradesh State Council of Higher Education (APSCHE) here on Friday bringing curtains down on a bitter war over assets and liabilities of a key institution between the two Telugu states.

The judgment was untenable in law and the freezing of accounts was bad in law, the bench felt. The bench which heard the arguments of both the governments in this regard in the past and which had reserved its judgment in the last hearing, said the argument of the Telangana government cannot be accepted.

Senior counsel of Andhra Pradesh P P Rao argued the purport of Section 75 of the AP Reorganisation Act, 2014 which dealt with facilities in respect of institutions, one could not stretch the provisions to the extent of apportioning the assets and liabilities. The bench felt if the Telangana state's argument were to be accepted then it would render section 47 of the Act useless and nugatory.
