An India-born doctor in Australia, convicted of sexually assaulting a patient, Friday won a court battle to overturn a ministerial decision to deport him.
Suhail Durani was jailed for more than 18 months for sexually assaulting the 19-year-old woman while examining her at Royal Perth Hospital's emergency ward in February 2010, ABC News reported.
Durani has been fighting to stay in Perth since he was released from jail after serving his term.
Durani was imprisoned in July 2011 and released on parole Feb 6, 2013, when he was taken into detention by the immigration authorities.
Former immigration minister Tony Burke last year overruled a decision by the Administrative Appeals Tribunal that had allowed the doctor to keep his Australian visa despite his conviction.
Durani appealed against the matter and the federal court ruled in his favour on Friday.
The court also ruled that the immigration department should pay Durani's appeal costs, the report said.
Durani arrived in Australia in 2006 and has a wife and child who are Australian citizens. He has now been released from detention.
He always maintained his innocence in the case.
