Hyderabad: Andhra Pradesh State Chief Secretary IYR Krishna Rao, who called on President Pranab Mukherjee, here on Tuesday, said AP was divided in haste “without anticipating the post-bifurcation problems and setting-up of a proper institutional mechanism to resolve these issues.” This is leading to a lot of avoidable friction between two new States.
He pointed out that about 142 institutions under Scheduled X, which include training institutions; a number of bodies, universities were clubbed under this schedule. But, there was no clarity in the Act as to how to apportion them between the two states. Since these institutions were built with the revenues of united AP, and their location either in Hyderabad or otherwise was a historical accident.
Hyderabad being the capital city the assets, liabilities and staff of these Institutions need to be divided on population ratio, he said. The division of most of the assets and liabilities as envisaged in the Act was based upon population ratio and the request of AP was to apply the same to these institutions too, he added.
The chief secretary further told the President that a case on this has been pending before the Supreme Court, and as per the act, wherein both governments fail to reach a mutual agreement within one year from the date of bifurcation; it would be the responsibility of the Centre to decide on the modalities of division of these institutions.
Since the case is pending with the SC, no action was initiated by the Centre. However, TS has taken over most of these institutions and insisting on a MoU and payment of charges to avail these facilities, said the chief secretary. With regard to the Schedule IX, Krishna Rao said that most of them were commercial institutions, and the centre has appointed Sheila Bhide Committee for the division of assets and liabilities.
While the AP has been asking for division on the basis of population but TS has been insisting on division of staff on the basis of nativity. If the division is done as per the request of TS, then these commercial undertakings in AP would be saddled with huge wage bill and could go sick,” he said.
Rao said in the meantime the TS government had relieved employees of its Power Utilities, based on nativity and asked them to join in Andhra Pradesh power utilities, he said. Since, this was not the criterion agreed upon, AP has not taken them into service and they are making rounds of different offices.
They even approached the High Court and got a "status quo ante" order. Yet, the TS has refused to implement the same, he said. Against this backdrop, he asked the President, to direct the TS to maintain status quo ante, pending formulation of guidelines in a mutually accepted manner on staff division, or as per the decision of the Centre, under Section 108 of the APRA.
The chief secretary has also impressed upon the President on the necessity of implementing Section 8 of the act, giving him a detailed report on how the senior officials of AP have been humiliated.
