HC says no interim orders on plea against defected MLAs

Hyderabad: A two-judge vacation bench of the High Court at Hyderabad comprising Justice A Ramalingeswara Rao and Justice T Sunil Choudary on Thursday refused to pass any interim orders in a petition questioning the election process for selecting Members of Legislative Council. The bench was dealing with two petitions, one filed by E Dayakar Rao of TDP and the other by Sampath Kumar of the Congress party.


The TDP leader complained that though Talasani Srinivas Yadav, Teegala Krishna Reddy, and Dharma Reddy won on a TDP ticket, they defected to the TRS and should be ordered to stay away from the elections. A similar writ petition was filed by the Congress leader naming Yadaiah, Reddya Naik, Kanakiah and Vittal Reddy.


Appearing for the petitioners, Jandhyala Ravishankar pointed out that proceedings against the said MLAs under the Anti-Defection law was underway and the MLAs must refrain from casting their votes in the MLC elections. The counsel requested the court to direct the returning officer to keep the ballot paper of these MLAs in sealed envelope.

The bench said that it was not inclined to entertain such writ petitions and pass orders at this stage of election process and posted the matter to June 2.
