GHMC head honcho moves CAT against allocation to AP
A division bench of Central Administrative Tribunal comprising BV Rao and Rajana Chowdhury on Monday heard inconclusively arguments on behalf of GHMC Commissioner Somesh Kumar. The GHMC commissioner moved the Central Administrative Tribunal questioning the action of allocating him to the state of Andhra Pradesh.

HYDERABAD: A division bench of Central Administrative Tribunal comprising BV Rao and Rajana Chowdhury on Monday heard inconclusively arguments on behalf of GHMC Commissioner Somesh Kumar. The GHMC commissioner moved the Central Administrative Tribunal questioning the action of allocating him to the state of Andhra Pradesh.
The petitioner pointed out that initially he was allotted to the State of Telangana. However, on the recommendations of Pratyush Sinha Committee he was allotted to Andhra Pradesh. The petitioner pointed out that the process of allotment was rebelled into illegality and arbitrariness.
Senior Counsel DV Sitaram Murthy appearing for the petitioner pointed out that the classification of IAS officers as insiders and outsiders and extending certain option benefits across the ‘roaster band’ to insiders and restricting it to the batch of outsiders was arbitrary and illegal.
The bench voiced surprised at the classification and wondered how the Government would justify it. D V Sitaram Murthy also pointed out that the Kamalanathan Committee had provided for the placement of the spouse as one of the option grounds but the Pratyush Sinha Committee of IAS officers has restricted such committee to those whose spouse was also in the IAS cadre.
He argued that the presence of ex-chief Secretary vitiated the process of laying down guidelines as the daughter and son-in-law of the ex-chief secretary were IAS officers in the state and this introduced the likelihood of bias. The Bench will hear the matter next week.
