Hyderabad: Telangana Assembly on Wednesday passed a new Bill for land acquisition by tweaking the central government’s Land Acquisition Act 2013.
The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Telangana Amend) Act 2016 enables the government to acquire land for public good and in the “national interest”.
This Act aims to remove certain provisions that, the government feels, were obstructing its developmental plans.
It brings in Chapter III-A in the principal Act, giving the state government the power to acquire land for projects of national importance, infrastructure projects (electrification and irrigation), affordable housing and housing for the poor, industrial corridors and for infrastructure projects taken up by the government and through public-private partnerships.
Intervening during the discussion, Chief Minister K Chandrashekar Rao said the state legislation was better than the central Act. He said the central Act was brought in an irresponsible fashion.
Brushing aside the objections by Congress party members, KCR said that the state government had the right to bring the Act.
He said Gujarat, Rajasthan and some other states had already enacted their own land acquisition Acts for speedy completion of the projects. This Act would help in preventing litigations which were the creation of a few opposition parties.
The new Act would replace the controversial GO No 123 issued by the state government on July 30, 2015 which gives power to the state government to acquire land by paying one-time cash.
GO123 was strongly opposed by opposition parties and farmers’ organisations and the High Court had recently struck down the GO. Following this, the state government decided to bring in the new land acquisition Act.
Introducing the Bill in the State Assembly, Minister for Irrigation T Harish Rao said that it aims to ensure expeditious procurement of land for public purposes in a speedy manner with higher compensation and rehabilitation.
