BIFURCATION OF HIGH COURT
New Delhi: The delay in bifurcation of the High Court is rapidly escalating into a major confrontation and has gone to the extent of Chief Minister of Telangana K Chandrasekhar Rao threatening to stage a dharna at Jantar Mantar in New Delhi blaming the Centre of supporting Andhra Pradesh because it is allied with its Chief Minister Chandrababu Naidu.
Taking strong objection to the remarks of KCR, Union Law Minister D V Sadananda Gowda said KCR was behaving like Delhi Chief Minister Arvind Kejriwal in threatening a dharna in the national capital. "We have tried to do our best. They cannot keep blaming the Centre. The matter is subjudice as a PIL is pending in court. So we cannot do anything much on this for now," he said.
Gowda advised KCR to read the AP Reorganisation Act 2014 fully and properly to understand the issue of Telangana High Court constitution. This followed the representations of TRS MPs led by K Keshav Rao, Vinod Kumar, Vishweshwar Reddy and Jitender Reddy and Union Minister of State B Dattatreya along with Telangana Bar Council Chairman A Narsimha Reddy, BJP Parliamentary Party Secretary Balasubramanyam and Legal Convenor of the party for Telangana Uday Kumar to the Union Minister for Law.
After hearing the two sides patiently, the Union Minister categorically reiterated that the bifurcation of the High Court was not under the purview of the Centre. Setting to rest any speculation on the Centre's intervention in this contentious issue, the Union Minister for Law said, "The bifurcation of the High Court is not under our purview. I spoke to both the Chief Ministers in this regard in the past.”
He further stated that Dattatreya explained to him the situation in Telangana on this count and the agitation being waged by the legal fraternity. He further said the TRS MPs' delegation also expressed concern over the delay and elaborated on the sentiments of the agitating Judicial personnel and the subsequent suspension of some of them for their protests by the Chief Justice of the High of Court of Judicature, Hyderabad.
He said it was up to the AP Chief Minister to provide the basic infrastructure for the high court in AP first for the court to be shifted. "I cannot comment on AP CM's attitude in this regard. There are some petitions pending in the High Court and hence I cannot comment on the same. The Centre won’t interfere in this issue at all,” he said.
As for, the regional imbalance in the judiciary we have a report too to support the Telangana contention that a majority of the judges are from Andhra Pradesh and Telangana lags behind in this. But, it is for the Chief Minister and the Chief Justice of High Court to thrash out the issue. They should sit together and look into the appointments, he added.
He said, "You (KCR) cannot blame Narendra Modi Government on this issue and doing so was unacceptable and intolerable. Creation of a new High Court is in the hands of Chief Minister and Chief Justice of that High Court."
