TS govt presents various permutations before the bench
Hyderabad: The Telangana government on Tuesday told the High Court in clear terms that it wanted a separate High Court as soon as possible. It threw up various permutations before the bench comprising Chief Justice Kalyan Jyothi Sengupta and Justice PV Sanjay Kumar which included a separate establishment for the two states in the same building or even either of the government shifting out with the Telangana government ensuring all possible assistance to the AP government.
Telangana Advocate General K Ramakrishna Reddy said communications were sent to the government of Andhra Pradesh and the Central Government in this regard. The Andhra Pradesh government in its affidavit attached a letter written by Chief Minister Chandrababu Naidu. The CM in his letter said “The people of AP are anxiously looking forward to the shaping of new capital and constitution of the High Court being one such prominent entity and state administration is also equally keen in constituting the same in capital region.”
It further read “The Central Government shall provide special financial support for the creation of essential facilities in the new capital of the successor State of Andhra Pradesh including the Raj Bhawan, High Court, Government Secretariat, Legislative Assembly, Legislative Council, and such other essential infrastructure.” The letter also read that the government of AP has no objection for constitution of separate High Court as per Section 32 of State Reorganisation Act and the mention of Section 94 (3) is the icing on cake.
The Central Government in its affidavit informed the court that it was up to the state government to establish a new High Court and that it was up to the state of AP and Chief Justice of the High Court at Hyderabad to respond to the demands of a new High Court. The bench adjourned the matter to Wednesday for further hearing.
