Hyderabad: Parliamentary Committee on Personnel, Public Grievances, Law and Justice, Chairman E M Sudharsana Natchiappan on Friday said the committee was considering establishing fast track courts for settling commercial disputes. Addressing a press conference here on Friday, Natchiappan said the idea to introduce the fast-track courts for settling commercial was being considered because the existing redressal system resulted in heavy pendency of cases.


There were 740 High Court judge vacancies. There were about two crore cases pending from subordinate to High Courts. The 14th Finance Commission recommended allotment of more funds to strengthen the courts in the country. Though efforts of that nature were being made to strengthen the existing courts, it cannot be done overnight, he said.


Unlike in China, the judicial system in the country was a time-tested one. However, investors coming to invest in the industries and commercial activities in the country would expect quick solution of their disputes arising out of commercial dealings. They were even ready to pay for such system. As of now, they would have to go to Singapore and other such places for arbitration, mediation and reconciliation processes.


Now, it was envisioned to have the same system in the country to facilitate international arbitration and reconciliation process for quickly resolving the commercial disputes. Apart from this, it was mooted to establish special fast track courts from district to the State level, to handle commercial disputes. And, these courts can try disputes having a jurisdiction to try disputes with around Rs 1 crore value.


For this, the committee had already visited few states like Maharashtra, Kolkata, and would visit Tamil Nadu, Chandigarh, Jammu and Kashmir to seek the opinion from different stakeholders, including governments, judiciary and others. These efforts would create a Super Highway for quickly resolving commercial disputes, he pointed out.


According to one estimate, about Rs 1 crore lakh funds of public sector banks and entities had been reportedly entangled in the litigation. And, there was no data available as to the extents of funds from the private entities have been caught in the litigation, he clarified.


The proposed alternative dispute resolution system would help in even the non-advocates to present their disputes in the adjudicating authority. Besides, it would help in acquiring the domain expertise in mediation, reconciliation and arbitration, for quickly resolving the disputes, he pointed out.
