Hyderabad: Telangana State Chief Minister K Chandrasekhar Rao once again stirred the hornets’ nest by reiterating that his government does not recognise the special powers accorded to the Governor under the AP State Reorganisation Act.

Talking to the media on Sunday, Rao said it was a ploy of the UPA government to include the clause of special powers to the Governor so that the Seemandhra leaders would not object to the passage of the Bill on bifurcation of the state. The TS governor has no additional power than what the governors of other states enjoy under the Constitution. He will have to act as per the advice of the council of ministers. He said so far only the Governor of Arunachal Pradesh had special powers. He was given special powers after amending the Constitution. Whereas no such amendment had taken place here, Rao said.

However, legal experts feel that the Governor enjoys special powers since the AP State Reorganisation Act has been passed by Parliament and for the first time, the Centre has also decided that two states will have common capital for ten years. They say that while it is debatable whether the Governor should be given powers to have full control on the role of the police including transfers or not, the TS government cannot question the special powers of the Governor. He has absolute control over law and order. He could restrict the movement of and order the arrest of any person under the law. This being the situation, how the Chief Minister can say that the governor does not have additional powers, say a legal expert. Whether it will stand the scrutiny in a court of law or not is a different issue but as of now, the Governor has more powers than other Governors, the source added.
