The detenue Kumar Bagalkote of Karnataka was detained under the Goonda Act for cheating people with false promises of medical cure for ailments, including cancer, paralysis, spondylitis.

The Telangana State government issued orders of Preventive Detention in September last. The petitioner pointed out that the order of detention and the grounds of detention were served on him in Kananda, the language he was familiar with but the supporting documents were given in Telugu.

This, he argued, was contrary to the statutory requirement that required service of all documents in the language known to the petitioner.

The bench upheld his contention and pointed out that the authorities by their action had deprived the petitioner of his valuable statutory right.
